Terms & Conditions of Trade

As one of New Zealand’s premium new-home builders, SALT is committed to operating with clarity, integrity, and professionalism.

Please review our Terms & Conditions below:

These Terms of Trade apply to all work carried out by SALT for our clients. By engaging SALT, signing a proposal, or paying a deposit, you agree to these terms.

1. Definitions

  • “SALT”, “we”, “our”, “us” – SALT Design. Build. Live.

  • “Client”, “you”, “your” – The person or entity engaging SALT’s services.

  • “Project” – Any design, build, consultation, or construction work delivered by SALT.

  • “Quote/Proposal” – A written offer setting out scope, price, and inclusions.

  • “Variation” – Any change to the agreed scope, materials, design, or timeline.

 

2. Scope of Work

SALT will carry out the services outlined in the approved Proposal.
Anything outside that scope is considered a Variation and may incur additional cost and time.

 

3. Quotes & Pricing

  • Quotes are valid for 30 days unless stated otherwise.

  • Pricing is based on the information provided at the time of quoting.

  • If new information arises (e.g., site issues, engineering changes, supply changes), SALT may revise pricing.

  • All prices are exclusive of GST unless stated otherwise.

 

4. Deposits & Payment

To begin work:

  • A non‑refundable deposit is required to secure the Project and confirm scheduling.

  • Progress payments will be invoiced at key milestones (design phases, approvals, procurement, construction stages).

  • All invoices are due within 7 days of issue.

 

Failure to pay may result in:

​

  • Suspension of work;

  • Withholding of documents, certifications, or materials;

  • Interest on overdue amounts;

  • Recovery of debt collection costs.

 

5. Variations

Variations occur when:

  • The Client requests changes.

  • Council, engineering, or compliance requirements change.

  • Material specifications change.

  • Unforeseen site conditions arise.

  • Supply chain constraints require substitutions.

 

All Variations:

  • Must be approved in writing (email is acceptable).

  • Will be charged at current labour + material rates..

  • May extend the Project timeline

 

6. Client Responsibilities

You agree to:

  • Provide accurate and complete information;

  • Ensure site access for SALT, subcontractors, and suppliers;

  • Keep the site safe, clear, and compliant;

  • Make decisions promptly to avoid delays;

  • Obtain any approvals or consents you are responsible for (unless SALT is engaged to handle these).

 

7. SALT Responsibilities

We will:

  • Deliver workmanship that meets or exceeds NZ Building Code requirements;

  • Use qualified subcontractors and compliant materials;

  • Communicate clearly throughout the process;

  • Work to agreed timeframes where reasonably possible;

  • Maintain health and safety compliance at all times.

 

8. Delays

SALT is not responsible for delays caused by:

  • Weather;

  • Council processing;

  • Client variations or late decisions;

  • Supply chain disruption;

  • Subcontractor or manufacturer availability;

  • Unforeseen site conditions;

 

Any such delays may extend the Project timeline.

 

9. Warranties

SALT provides:

  • All warranties required under the Building Act 2004;

  • Manufacturer warranties for supplied materials;

  • Workmanship warranties as specified in the Proposal.

 

Warranties do not cover:

​

  • Wear and tear;

  • Misuse, neglect, or lack of maintenance;

  • Damage caused by third parties;

  • Client‑supplied materials.

 

10. Health & Safety

SALT complies with the Health and Safety at Work Act 2015.
Clients must not interfere with any safety controls in place on the site.

 

11. Liability

  • SALT’s liability is limited to the value of the work supplied.

  • SALT is not liable for loss of profits, consequential loss, or delays beyond our control.

  • The Client is responsible for insuring the property and any partially completed work.

 

12. Intellectual Property

All designs, drawings, plans, concepts, and documentation remain the exclusive property of SALT unless paid in full and formally released.
They may not be shared or used by any other party without written permission.

 

13. Termination

Either party may terminate the agreement if the other party breaches these terms and does not remedy the breach within 10 working days.

If the Client terminates:

  • All work completed to date must be paid for in full;

  • Materials ordered on the Client’s behalf must be paid for:

  • Deposits are non‑refundable.

 

14. Privacy

SALT collects client information only to deliver our services.
All information is handled according to the Privacy Act 2020 and will not be shared without consent unless required by law.

 

15. Acceptance

By engaging SALT, signing a proposal, paying a deposit, or instructing us to begin work, you agree to these Terms of Trade.
